It is an unfortunate fact of modern living that occasionally people suffer violence at the hands of criminals through no fault of their own.
If you are unlucky enough to be attacked and suffer injury as a consequence of someone else’s violent criminal act then it is possible to pursue a claim through the Criminal Injuries Compensation Authority for damages resulting from that attack. Unfortunately, the Criminal Injuries Compensation Authority will make no contribution towards your legal fees. In the event that you do not have adequate legal protection cover then our fees will need to be deducted from your compensation. We normally agree with you at the outset a set percentage which we cannot go over regardless of the amount of work we have done. For example, a common percentage would be 33%. That is to say that in the event that you pursue a successful application through the Criminal Injuries Compensation Authority, then we would deduct 33% of your damages in respect of our costs. This would be regardless of how much work we had actually done on your behalf.
It is important to note that any person applying for compensation through the Criminal Injuries Compensation Scheme should be free of any criminal record. If you do have a criminal record then you may suffer some deductions as a consequence. We would advise you to speak to your solicitor for full details.
